La peticionaria argumentó como causales de nulidad el desconocimiento de la jurisprudencia en vigor y el hecho de haberse dejado de examinar un asunto de relevancia constitucional con efectos trascendentales para la decisión adoptada.
La Sala Plena consideró que el mencionado fallo no incurrió en las omisiones que le fueron atribuidas y que por tanto procedía descartar tanto la vulneración del derecho al debido proceso alegado, como la estructuración de la nulidad solicitada.
